General
Definitions
‘Tourinco' means any engagement with the Tourinco business, including but not restricted to the Tourinco.com website, email with an @Tourinco.com email address, communicating by post, phone or text message and use of our social media channels.
‘Provider' means the activity provider, such as a tour operator, outdoor activity centre or attraction.
‘You' means the person named in the booking and the person if not the same, who has entered into this contract.
Your use of this site
You may use our site only for lawful purposes. By using Tourinco and its marketing channels (such as Facebook) you agree to be bound by these terms and conditions, which take effect immediately.
If you do not agree to these terms and conditions herein, please do not access Tourinco.
Viruses, Hacking and offences
You must not misuse our site by knowingly introducing viruses, trojans, worms or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site or business. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you may commit a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
Copyright and intellectual property
The text and imagery published by Tourinco are copyright Tourinco and its providers and affiliates unless otherwise stated. No part of the Tourinco website, its code, content, functionality or imagery maybe reproduced in part or in whole without the written approval of Tourinco.
Controlling Law and Jurisdiction
These terms and conditions and any contract you enter into with Tourinco shall be bound by the law of Mauritius, plus any other relevant consumer protection law that applies in the country of which you are normally resident.
These terms and conditions constitute the entire agreement between you and Tourinco. Neither party has relied upon any statement or representation made by the other in agreeing to enter this contract.
Purchasing on Tourinco
Availability
All bookings are offered on a first come, first served basis. An offer of availability does not guarantee booking and availability changes on a minute-by-minute basis.
We quality control information provided about products marketed for sale. However, Tourinco does not warrant that, content pricing or information offered by Tourinco be uninterrupted or error free.
Pricing
Prices are per person unless expressly stated in the product details. Offered Prices are subject to change without notice until a booking has been confirmed.
Payment
In line with the PCI Compliance we do not store your credit card information. Tourinco uses a third party to authorise credit / debit card transactions through our website. If you opt to pay using Paypal you are bound by their terms and conditions.
Local sales tax
Where applicable, all local sales taxes, VAT or any other compulsory levy set but local or national government, trade body or association in the country of product delivery shall be included in the advertised price. This does not include at your discretion, tips, donations or any other payment you choose to make.
Rounding off
Where a currency exchange is being used (for example where the product is provided in a different currency zone to the one it is being purchased in), Tourinco may by its discretion, round up or round down amounts that are payable to the nearest whole unit.
Changes to your booking by us
Once a booking is made the provider guarantees that you will be provided with the product as described. However, from time to time changes may be necessary to allow the provider to undertake its obligations to you. Thus, Tourinco reserves the right to cancel or amend a booking or substitute another product in place of your existing booking.
Where a change to a purchased product takes place, you will be notified by email and through the ‘my account' page. If the product is no longer suitable, you are entitled to a refund.
Withdrawal of the product or provider
Where the product is no longer available or the provider no longer operates, we will endeavour to arrange for the same experience to be delivered at a convenient location. If this is not possible we will offer a full refund.
Changes to your booking within 28 days
Within 28 days of the start of the booking, you are bound to the booking without exception.
Inclusions/Exclusions
All inclusions or exclusions from a product are provided before purchase. Where a supplier offers optional extras which are not included in the product be default (for example optional entry to a tourist attraction which is part of a tour itinerary but not included in the tour price), this will be clearly stated.
Related purchases / up-selling
Where a product has the option to add additional elements (for example a photography package) these will be available for separate purchase. The terms and durations of the original purchase contract apply to any related purchase / up-selling.
Requesting a refund
You are entitled to request a full refund without notice or reason up to 28 days before the start of your booking.
Resale of products
You are not permitted to re-sell any product purchased through Tourinco, whether or not this is for profit unless you choose to offer for re-sell your booking through the Tourinco marketplace.
Your responsibilities
Your conduct in the contract
You agree to conduct yourself in a reasonable and proper manner for the duration of the contract. You agree that you are using Tourinco and its providers for the sole purpose of your own entertainment and there is no other personal gain (such as payment for favourable review or facilitating anti-competitive gain) other than for the sole purpose of taking part in the activity.
Your conduct on the day
You agree to conduct yourself in a reasonable and proper manner. The supplier reserves the right to refuse entry or evict you without compensation for any reason including but without limit; if you are behaving in a manor to put yourself or others at risk; appear to be under the influence of alcohol or drugs; use any foul or abusive language or obscene gestures, remove any clothing or wear clothing that is likely to cause offence to others.
You agree to follow signage or direction from the provider and agree not to enter any private or restricted areas without prior consent. The use of cameraphones / filming / recording equipment is to be used in such a way as not to be intrusive to other customers or members of the public and must not be used for commercial purposes.
By attending the event you give your consent to appear in filming and press promotion by Tourinco or the supplier.
Children & minors
Where a person under the age of 18, or a person classified as a child in the country of product delivery, they must be accompanied by a responsible adult. The responsible adult must be with the child at all times and this may require the adult to take part in the product.
Passports & Visas
It is your responsibility to hold valid the relevant passport and / or VISA for entry to the country that the product takes place.
Insurance
Whilst all suppliers hold the relevant insurances to allow them to deliver the product, we recommend that you purchase a comprehensive travel insurance policy prior to departure and that you check that your insurance policy covers you for participation in the product.
Late arrival
It is your responsibility to arrive on-time. If you arrive late, even if it is due to circumstances out-with your control, you may not be accepted on to the experience or tour. The provider of the experience will not be held liable for late-arrivals.
No-shows
If you fail to show for your experience or tour, you will forfeit your booking with no refund, re-booking or compensation.
Booking confirmations
It is strongly advisable that you take evidence of your booking with you on the day. This can be by printed confirmation or on your phone / tablet. We advise taking a screen grab / photo of your confirmation if you intend to present it digitally.
The providers’ responsibilities
Safety
We require the provider to offer you all required safety equipment within the price of the product. We stipulate that all equipment must be in good working condition and checked regularly. We require them to comply with all legislation and trade association standards and where applicable, display certificates for you to see before the start of the product.
Qualifications
We require the provider and it's staff to hold all required professional qualifications to allow them to offer the product. Where applicable, display certificates for you to see before the start of the product.
Professionalism
We require the provider to conduct themselves in a professional manner and to ensure that customers are looked after in a courteous and timely fashion. We require them to have at least one member of staff to be able to speak fluent English and where practical to offer a range of languages for international visitors.
Communication
We require the provider to communicate any changes or information that is relevant to your booking as soon as they know of any changes to the circumstances surrounding your booking. We require them to communicate with you in a courteous and professional manner and respond to messages in a timely fashion.
Handling complaints & disputes
Complaints about Tourinco
Complaints about Tourinco should be put in writing using the customer service form or my account page at the earliest opportunity. A manager will investigate the complaint and endeavour to solve any issue within 48 hours of receipt of a communication fairly and reasonably. The decision of Tourinco will be final.
Complaints about the provider
Complaints about the provider must be logged with the provider at the time and they should be given a fair and reasonable opportunity to resolve a problem. Where you feel the resolution is unsatisfactory, please contact Tourinco customer service.
Disclaimers & Limitations of Liability
Injury or death
Tourinco is not liable for any injury, death, mental distress or any condition developed as a result of partaking in and activity promoted on, or purchased through Tourinco. Public liability is held and underwritten by the experience providers.
Weather and natural disaster
Sometimes bookings have to be postponed due to weather or natural events out-with the control of the provider. We recommend that you contact the provider on the day of your booking to confirm that the experience is going ahead. Where a cancellation takes place as a result of weather or natural disaster, you will be offered a re-booking or refund.
Force Majeure
Tourinco will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control including Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute, or acts of local or central Government or other competent authorities.
Safety
By partaking in the product you may be placed at some personal risk. You maybe asked to sign a risk waiver or personal liability form on the day. The provider will provide full safety information and equipment and we urge you to listen to safety briefings and seek clarity on any area you are not sure of before the activity starts.
Loss
Tourinco shall not be held liable to the customer for loss of profit, revenue, income, contracts, anticipated savings or any other indirect or consequential loss.
Limitation of liability
In any event, Tourinco shall not be liable to Customer for any sum greater than the original transaction value.
